Work Permit for Foreign Students

According to the New Law on the İnternational Labor Force, foreign students who are enrolled in formal graduate programs as Master’s or Ph.D program  in a higher education institution in Turkey are able to work and apply for work permit.

However, foreign students who are enrolled in associate degree or undergraduate programs in Turkey are given the right to work no more than 30 hours a week following the first year of studies.

Work permits granted to the foreign students do not terminate the valid student residence permit and the rights granted by this residence permit. Procedures and principles regarding the employment of foreign students are determined by the Ministry by taking the opinions of the Ministry of Internal Affairs and by taking into consideration the principles determined by the Immigration Policies Committee.

In the event that the foreigners who completed their higher education in Turkey apply for a work permit within one year as of their graduation date, the application shall be evaluated in accordance with the principles determined by the International Labour Policy Advisory Board.

Important: Please be informed that foreign students who granted state scholarship in Turkey during the Bachelor degree are not able to get work permit after the graduation even if their type of residence permit has been changed to the short term residence permit.

According to the Turkish Law a foreign Citizen cannot apply for a work personnaly.

Hi
İ have just graduated and found a firm willing to employ me. Can İ apply for a work permit with my current student residence permit (which expires on september 24th) or will i need a short term residence permit. Furthermor,is it possible for me to begin employment with the firm (part or full time) as soon as i finish the applications, or must i wait for the work permit to arrive.

Dear Mr Ebrahim,

According to the Turkish Work Legislation, only Student of Masters in their last year can apply for a Work Permit. In your case you can re-apply for a new type of Residency Permit without waiting for the expiration of you current Residency Permit.

Also you can only start to work legally once your Work Permit application has been validated.

Dear Mr Gurkirat,

In Turkey Work Permit can only be delivered to Foreign Citizens if they have already found an employer. The application for the Work can be both made from abroad or from inside of Turkey. You should note that the domestic application have different requirement. Thank you for granting us all this info.

My employer is willing to file for a work permit for me. However as a last year MA student my current residency permit expires September 30th.
Shall I go ahead and apply for renewal? Or wait and have the Renewal and the Work permit application filed together?

Dear Sir/Madam,

In order to apply for a Work Permit you are required to have a valid Residency Permit. We strongly advise you to have at least 2 month of valid Residency before applying for a Work Permit. If your employer is willing to employ you now we can make the Work Permit application.

I have two question

One is relating to New TCC Turkish Commercial Code 359. is the foreigner member of broad for a company has to get work permit or not?

For master degree student with student visa has the right to work like part time or has to apply for work permit ?

Dear Mr Shadi,

Member of board of companies must have a Valid Work Permit in order to exerce their functions.

Students of Master Degree who are in their last year of study can work in a full time job, however they are required to have a work Permit. Even if the law state that University student can work as part time, the regulation and the application of the hasn’t come into force yet.

You can check the law No 6735 concerning the Foreign Citizens employee inTurkey and the Law No 6458 about Immigration in turkey.

Hi I’m an undergraduate Student in my second year in Turkey and i want to register a company with my Turkish friends for our business idea.. this is solely for the purpose of having credibility when we approach investors because the idea is in prototype stage and we won’t be earning anything for a while…what I wanted to know is can I start a business on a student permit and if not then what’s the procedure for a Turkish work permit.. Also one final question can I continue my education with a work permit or not thank you 🙂

Dear Mr Nausherwan,

You can establish a company in Turkey with you Student Residency Permit. However you will not be allowed to get a Work Permit based on your company. Only Student of Master Degree in their last year are allowed to apply for a work permit.

Dear Mr Haissam,

Since you are in your last year of Master Degree you are allowed to apply for a Work Permit. To be allowed to apply for the Work Permit you should first find an employer in Turkey. Our company can provide you with all the required Consultancy Service for the Work Permit application.

Thanks for your cordial reply. I just got residence permit renewal today but its till feb 21 2018. My concern is now its nick of the time of 6 months validity to apply for work permit even if i get job. But i will change the permit to short term residence permit in jan 2018. My question or concern is on 2 issues:

1 . There are many tyoes of short term residence permit application, for me it can be application as completing higher education in turkey, but for this type it will not be renewed after 1 year. So will i apply for 1 yr touristic short term residence which can be renewed after its expiry?

2. Can i then apply for work permit based on that touristic 1 yr short term residence permit ?

3. Will then later on in citizenship application it will be considered as continous staying in turkey? ( as i am student permit holder since 2013)

Dear Mr Haissam,

You can find the answers to your questions bellow :
1. Yes you can apply for a Touristic Residency Permit once your current Student Residency Prmit get expired.
2. Yes you can apply for a Work Permit with a valid Residency Permit.
3. If you keep the Touristic Residency Permit for more than 6 month you will not be considered to have stayed continuously.

In the following semester I will do an semester abroad in turkey. Besides my master studies, I work as an working student in Germany, for a German company which only is active in the German market.

Do I need an extra permission to work for this company during my stay in turkey ?

Dear Mr Tony,

If your work include working in Turkey this stay and your employer is a Turkish company you will have to be registered in the Turkish Social Securtiy. It this case you will be required to get a Work Permit.

However if you employer is abroad you will not be declared in the Turkish system so you will not need a Work Permit.

Dear Mrs Nadia,

Since you will be a PhD student you will be allowed to apply for a Work Permit without a Problem. The scholarship won’t be a problem for the Work Permit.

I am a foreign PHD student in the first year in Turkey , I want to work for a foreign company but according to the working laws in turkey they told me that they need to hiring five Turkish citizens employees to be able to get a work permit but they have only three , what’s your advice in this case?

Unfortunately according to the Turkish law every company which will employ Foreign Citizens need to employ at least 5 Turkish employee.

Hello , Im marrocan and i i want to study in turkish (Graduate) , and i have two questions
1: Can i legally work in my free time
2: if yes , a part work salary (waiter.barman…) will it be enough for to pay all the bills (Rent,Food,electricity,internet,light shopping)

Hello,

Firstly, let me inform you that in order to work in Turkey legally, foreigner should have a work permit, which could be gotten by employer.Moreover, Graduate students are allowed to apply for a work permit during their study and work here legally.
Regarding part time job salary and whether it is sufficient to cover your accommodation and other expenses, it depends on the city and location of your rental apartment, but at least it will cover part of your expenses.
