Types of Work Permits

As a general rule individuals who have no citizenship bond with the Republic of Turkey, in order to work either dependently or independently, are obliged to have a valid work permit before they start to work. The rules and principles of Non Turkish citizens’ entry to the Turkish labor market are governed by the New Law on International Labour Force (law no. 6735) which was enacted on 28th July 2016.  The Turkish Ministry of Labor and Social Security is entitled as a competent authority for processing the work permit applications, granting, extending, restricting or canceling work permits.

TYPES OF WORK PERMITS


1. WORK PERMIT WITH DEFINITE PERIOD OF TIME

After taking several economic and demographic factors of the Turkish labor market into account, the Ministry of Labor and Social Security may grant a work permit for a definite period of time to the applicants. A Work Permit with definite period of time provides to the holders the right to work in an appointed profession, in a definite geographical zone, for an appointed employer within a specific time frame. By law, the work permits of definite period of time are valid at most for one year. At the end of the one year term, the work permit may be extended up to two years to work in the same job for the same employer. At the end of the two years extension, the work permit may be extended at most three more years to work in the same job for the same employer.

2. WORK PERMIT WITH INDEFINITE PERIOD OF TIME

A foreigner may be eligible for a work permit of indefinite period of time, if meets one the following criteria;
• The Foreigner should have been residing in Turkey legally and uninterruptedly for 8 years (with valid Long Term Residence Permit)
• The Foreigner should have a total legal working period of 8 years in Turkey. (with valid work permit)
The work permit of indefinite period of time is granted without taking the status of the business market into consideration. Moreover it is not restricted for a certain operation, profession, civil or geographical area.

3. INDEPENDENT WORK PERMIT

A foreigner who shall work independently on his/her own account may be granted with an independent work permit if he/she has legally and uninterruptedly resided in Turkey for at least five years.

An independent work permit for a definite period of time in line with Turkish International Labor Force Policy might be granted to the foreigners who shall work independently on him/her own behalf and account. Additionally, under new law, shareholder managers of limited companies, shareholder members of board of Joint Stock Companies and shareholder managers of Commandite Companies are required to obtain work permit.

4. TURQUOİSE CARD

Turquoise Card could be granted to foreigners as an indefinite work permit. The Turquoise Card would be granted through the recommendation of the Turkish International Labor Force Council by considering several factors such as the education level of the applicant, their professional experience, their contribution to science and technology, and the impact of activities and investments in Turkey on the economy and employment.

To the spouse and dependent children of the Turquoise Card holders, a document shall be given which indicates that they are relatives of a Turquoise Card holder and which can be used as residence permit.

As per article 11, Turquoise card might be granted for a transition period, first three years. The application for extension should be filed within 180 days before or in any case before the expiry date of the Turquoise card. Hi

Can you please advise if the work permit for 1 year or 3 or 4 years social insurance must be paid I mean 580 lira on monthly basis or on yearly basis or if I do not to pay this money what happens please and in case of 3 or 4 years work permit if the social insurance have to be paid can it be paid at the expiry date of work permit please?

Yes, the Social Security contributions should be made on the monthly basis. İf Social Securtiy payments will be avoid, then employer could be punished with the fine and employee’s work permit extension will be rejected by the Ministry of Labour.

Dear Mr Hamza,

According to the Turkish Law, Work Permit for Foreign National must be applied by the employer. You can’t get a work permit by yourself, you must first find an employer wishing to employ you and then the company will apply for your work permit.

The Turkish legislation does not discriminate any kind of disease or handicap. They cannot deport or cancel your work permit according to any kind of scar or sport or non-contagious disease.

sir i had done my TB illnes cured and from last 4 years am working in india but scar on chest in shows mark in x ray i am fully cured can still they deport for this illnes of past dubai deports i have read online due to scars is turkey too deport or it is the old trend for medical fitness.

According to the Turkish Legislation you work permit will not be cancelled because of any illness. however if your employer fire you your work permit will get cancelled.

Dear Mr Fahd,

You can apply for a Short Term Residency Permit at first if you wish to live in turkey for a certain amount of time. For this you are required to enter Turkey with a valid touristic Visa. Once you entered the Turkish territory with a valid touristic Visa we can start the application for a Short Term Residency Permit.

Residence permits do not replace work permits, so you absolutely have to get a work permit, foreigners who are not working but who work in a job are being deported.

I’m Peruvian married with a Turkish citizen
I already obtained my Turkish citizenship
My mother is planning to visit me and stay for a long period with us.
In this case should we apply for a residence permit?
If she will help us with the kids is there a way to apply for a working permit?
She just got retired from her job in Peru and she has free medical attention in the social security. Does Peru and Turkey have any agreement on their social securities? Which documents will we need to present to the Turkish Social Security?

As you are a Turkish citizen, you can apply for residence permit for your mother. Also, if your children are under 15 years old, obtaining work permit as a child care is possible. As we do not have informations about social securities agreements, you would need to contact Social Security Institution Directorate for details.

İt is only legal to work in the place that your work permit was obtained for. Part time job or working in any other insitution in the same time is not legal.

Turquoise Card has not been released yet and neither the details regarding application were explained. There is no information about when the card will be released. Follow our website to get the information as soon as there will be any news regarding Turqoise Card. If you are not employed in Turkey, you can not obtain work permit. For this purpose you need to find an employer or establish your own company. Please, be informed that in order to obtain work permit as a company owner, company’s paid capital must be at least 100.000 TL and there must be at least 5 Turkish citizens employed per each foreign employee including yourself.

International Protection Card holders can obtain work permit. This kind of work permit is not residence permit at the same time and can be extended for only 1 year each time. Application for work permit can be done only by a workplace located in the same city where foreigners are registered. Total amount of International Protection Card holders working in a particular workplace can not be higher than 10% of employees who are Turkish nationals. If there is no other employees or amount of Turkish citizens working in the company is less than 10, there can be only one IPC holder employed.

Dear Expat Guide Team,

I’m a British citizen who has been working in Ankara for over 11 years with uninterrupted stay. I am also married to a Turkish spouse for over 7 years.
My employer states that they will only apply for a 2 year work visa, not an ‘Indefinite Period of Time’, and that I have to personally apply for a long stay residence permit. As I understand, I am now able to reside in Turkey permanently and be able to work indefinitely. I do not hold Turkish citizenship and will not be applying for this. Can you explain which applications should be made?

After you obtain long term residence permit, you will be allowed to stay in Turkey permanently with no need to extend your residence permit each time, however you will not be eligible to work in Turkey on this basis. In order to work within the country, your employer still must obtain a work permit for you.
